WAIVER/RELEASE OF LIABILITY

PLEASE READ CAREFULLY BEFORE SIGNING.
THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.

I am the parent and/or guardian of (the "Participant(s)"). The Participant(s) and the undersigned parent/guardian of the Participant(s) agree and understand that swimming is a HAZARDOUS activity. I recognize that there are risks inherent in the sport of swimming, including but not limited to, paralyzing injuries and death.

The Participant(s) hereby agrees to participate in the Big Blue Swim School, LLC and the Participant(s) and undersigned parent/guardian of the Participant(s) hereby waive any potential or actual claim against Big Blue Swim School, LLC related to any injury that may occur to the Participant(s) while participating in any program or class sponsored by Big Blue Swim School, LLC or any of its affiliated. The Participant(s) and the undersigned parent/guardian further agree to indemnify and hold harmless Big Blue Swim School, LLC, its coaches, officers, directors, agents and employees against any liability resulting from any injury that may occur to the Participant(s) while participating in the Big Blue Swim School, LLC. The Participant(s) also agrees to indemnify Big Blue Swim School, LLC for any damages incurred arising from any claims, demand, action or cause of action by the Participant(s).

The Participant(s) and the undersigned parent/guardian of the Participant(s) authorize any representative of Big Blue Swim School, LLC to have the Participant(s) treated in any medical emergency during his or her participation in Big Blue Swim School, LLC sponsored activities. Further, the parent/guardian of the Participant(s) agrees to pay all costs associated with medical care and transportation for the Participant(s).

I have noted any medical/health problems of which the staff should be aware in the Participant's medical conditions in step one.

I hereby grant Big Blue Swim School the right to us my child's name, image, likeness, photograph, and/or voice in all forms and media for any material in connection with lawfully promoting or publicizing Big Blue Swim School.

POLICIES

Big Blue Swim School ("we") reserves the right to change these general rules and policies from time to time by posting updated policies on our website, www.bigblueswimschool.com (the "Website"). You acknowledge and agree that it is your responsibility to review the Website and the policies periodically to learn of any modifications. Your continued enrollment in the program after the posting of any modifications shall constitute your agreement to be bound by such modified policies.

Withdrawal Policy:

You are committed to lessons until you turn in a completed withdrawal form at least 30 days before your last lesson.

Make-Up Lesson Policies:

Each swimmer is entitled to one FREE make-up lesson each month. Additional make-up lessons are available at a rate of $12 per swimmer per lesson.
Private, semiprivate, Tadpole, and camp lessons are not eligible for make-up lessons.
Make-up lessons are granted based on our sole discretion. We are under no obligation to accept any make-up request.
All schedule make-ups are final.

Lesson Policies:

If we must cancel your child’s lesson (due to teacher illness, facility repairs, etc.) we will notify you as lessons will not be cancelled due to weather unless a weather emergency is declared by the city.
Should your child’s class fall on a holiday, we will pro-rate tuition accordingly.
If a teacher is ill/away, we reserve the right to use a substitute teacher for the lesson.

Payment Policies:

Lessons are billed on the first of every month.
We do not refund payments.
Make-up lessons or missed classes have no cash value.
Failure to provide a working credit card within 5 days after due date will result in a $10 service fee per swimmer.
Failure to provide a working credit card within 10 days after due date will result in a suspended account and a $40 cancellation fee per swimmer.

Guidelines for Students & Parents:

Please make sure your child is dressed and ready for lessons 10 minutes before class begins.
A Parent or a caretaker must check in each child and is responsible for the safety of each child unless that child is in the water with their designated instructor.
Let students from previous classes get out of the pool before getting in the water. Your child should NEVER the pool until your teacher is in the water and ready for the next class.
No running, no fighting, no shouting, and no horseplay while lessons are in progress.
If you child has a fever or contagious disease, please be considerate of other children by keeping your child home from lessons.
Please make sure your child uses the appropriate dressing rooms.
Please make certain your child has removed all bandages prior to class. If your child has an open cut or other wound, he/she may not be admitted to class.
While we welcome parental involvement, we've found that mid-lesson comments are usually counterproductive. Please email/phone the office for an update on students' progress.
We reserve the right to expel any student/parent who doesn't comply with these policies.
We reserve the right to consolidate classes due to low class size.
